Canada Authorizes First Tidal Energy Array Under New Adaptive Regulatory Framework

Fisheries and Oceans Canada (DFO) has granted the first Fisheries Act Authorization under the country’s newly implemented Staged Approach for tidal-stream energy development.

This approval allows Eauclaire Tidal Ltd. to deploy up to three Orbital O2-X devices at the FORCE test site in the Bay of Fundy.

The Staged Approach - developed by DFO and Natural Resources Canada through the federal Tidal Task Force - represents a major evolution in tidal energy regulation. The framework enables projects to begin with a single device, supported by targeted environmental monitoring, and expand only as evidence is gathered and assessed. This adaptive, data-driven process aims to provide regulatory clarity for developers while ensuring strong environmental protection.

With this new framework, the Canadian government is signalling a clear pathway for responsible tidal energy deployment.
